Good news for HSMP holders The High Court has ruled that holders of HSMPs granted before April 3 2006 can apply for Indefinite Leave to Remain after 4 years. The ruling made in the case of HSMP Forum limited earlier this month, found that such holders do not have to wait the prescribed 5 years but can revert after 4 years which was the time period in force when their application was granted. Tier 1 General PBS update The new qualifying level for the Tier 1 General is now in force and requires a minimum qualification of a Masters Degree and minimum salary of £20,000. If you are considering a Tier 1 General application, Smooth can assist. If you no longer qualify based on the new criteria there maybe another route we can advise you on. Fees abolished for Certificate of Approval for marriage/civil partnerships The UK Border Agency has abolished the fee for Certificate of Approval applications. The Agency is considering the implications for those who have already paid a fee and will shortly announce its policy with respect to this. Tier 4 PBS Update The UK Border Agency has now implemented Tier 4 of the Points Based System (PBS) for non-EEA students. Universities or Colleges wishing to recruit students from outside of the EEA are now required to obtain a Sponsor Licence under Tier 4 . Students wishing to study in the UK must now obtain a certificate of acceptance from their University or College and also qualify under the maintenance funds requirement. South African travel visas A new UK government policy will see South African tourists and business visitors requiring a Visitor visa, prior to departing from South Africa when visiting the UK. The new policy is being introduced following concerns regarding security on this route which is alleged to be a route exploited by people smugglers, illegal immigrants and suspected terrorists.
